Terms and Conditions

These Terms and Conditions apply to all quotations and work carried out by Tom O’Byrne Carpentry. By accepting a quotation, paying a deposit or instructing us to begin work, you agree to these terms.

 

Quotations

 

Quotations are valid for 30 days from the date of issue, unless otherwise stated.

 

The quotation will describe the agreed scope of work, materials and price. Any additional work or changes requested by the client may result in extra charges and changes to the agreed schedule.

 

Deposits and Payment

 

Payment terms will be shown on the quotation. A deposit may be required before materials are ordered or a booking is confirmed.

 

The remaining balance must be paid in accordance with the quotation. Bespoke or specially ordered materials may be non-refundable once ordered, manufactured, cut or prepared.

 

Scheduling

 

Start dates and completion times are estimates unless otherwise agreed in writing.

 

Dates may change due to supplier delays, unforeseen site conditions, illness, adverse weather, changes requested by the client or other circumstances outside our reasonable control.

 

Client Responsibilities

 

The client must ensure that:

 

- the work area is clear and accessible;

- children, pets and valuables are kept away from the work area;

- suitable parking or permits are available;

- we are informed of any known pipes, cables, damp, asbestos or structural issues; and

- any required permissions have been obtained.

 

Additional costs may apply where delays are caused by restricted access, an unprepared work area or incorrect information provided by the client.

 

Parking

 

The client is responsible for providing suitable parking or reimbursing reasonable parking and permit costs.

 

The client may also be responsible for a parking fine where it results directly from incorrect parking information or an invalid permit supplied by the client.

 

Existing Conditions

 

Our quotation does not include hidden or pre-existing defects unless specifically stated.

 

This may include damp, mould, rotten timber, damaged plaster, structural movement, hidden pipes or cables, or uneven floors, walls and ceilings.

 

Where additional work is required due to an unforeseen condition, this will be discussed with the client and may be charged separately.

 

Client-Supplied Materials

 

Where the client supplies doors, locks, fittings or other materials, the client is responsible for ensuring they are suitable, complete, undamaged and correctly sized.

 

Additional labour caused by unsuitable, incomplete, defective or incorrectly sized client-supplied products may be charged separately.

 

Our workmanship warranty does not cover faults in products or materials supplied by the client.

 

Cancellations and Changes

 

Cancellations or changes must be made in writing.

 

Where a contract is agreed online, by telephone or at the client’s home, the client may have a legal right to cancel within 14 days of the contract being agreed.

 

Where the client asks us to begin work or order materials during this cancellation period, the client may be responsible for work completed and reasonable costs already incurred.

 

Bespoke, personalised or specially ordered materials may not be refundable once ordered, manufactured, cut or prepared.

 

After any applicable cancellation period has ended, the client will be responsible for reasonable losses resulting from cancellation, including labour already completed, materials ordered, supplier charges and products that cannot reasonably be returned or reused.

 

Nothing in these terms affects the client’s statutory consumer rights.

 

Workmanship and Warranty

 

All work will be carried out with reasonable care and skill.

 

We provide a five-year workmanship warranty on carpentry installation work carried out by us, subject to normal use and full payment.

 

The warranty does not cover:

 

- normal wear and tear;

- accidental damage or misuse;

- damp, water ingress or inadequate ventilation;

- movement or defects in the property;

- natural movement, splitting or colour variation in timber;

- client-supplied products; or

- work altered or repaired by another contractor.

 

This warranty does not affect the client’s statutory rights.

 

Liability

 

We are not responsible for pre-existing defects, normal wear and tear, damage caused by other contractors or matters outside our reasonable control.

 

We will not be responsible for unavoidable minor damage to surrounding decoration where existing doors, frames, trims or fittings must be removed, provided reasonable care has been taken.

 

Nothing in these terms excludes liability where it would be unlawful to do so or limits the client’s statutory consumer rights.

 

Photographs

 

We may take photographs for job records and quality-control purposes.

 

Photographs will only be used for our website, portfolio, advertising or social media with the client’s permission. Personal details and full addresses will not be published.

 

Governing Law

 

These Terms and Conditions are governed by the laws of England and Wales.
